Conditions of Use
Tourism Dunedin and Dunedin City Council (DCC) manage the DunedinNZ.com image library. DunedinNZ.com is willing to license the use of the Images to you only if you accept all of the following Conditions of Use. Please read these Conditions of Use carefully because downloading and/or using the Images will be deemed to be your acceptance that you are using the Images on the following terms. The Images available at the image library hosted at www.DunedinNZ.com are protected under copyright and other laws of New Zealand, international conventions and similar laws abroad. Unless otherwise stated, copyright and other intellectual property rights in the Images, is owned or controlled by the photographer or Tourism Dunedin and DCC.
You and only you are authorised to use the Images on a royalty free, non-exclusive and non-transferable basis subject to the following conditions:
- You may only use the Images for the project or promotion referred to in the request submitted to Tourism Dunedin or DCC.
- If you wish to use any Image for another project you are required to submit a new request to Tourism Dunedin or the DCC.
- Unless this licence is earlier terminated by DunedinNZ.com your right to reproduce the Image will expire on the date notified by DunedinNZ.com to you when DunedinNZ.com confirms its acceptance of your Project Request.
- The Images may only be used for the purpose of promoting Dunedin as a visitor destination, and for no other purpose.
- These Images must not be used for paid advertising or for individual tourism product unless prior approval is granted in writing.
You warrant that you shall not at any time take any step or make any omission that brings the reputation or good standing of the author of the Image, Tourism Dunedin, DCC or Dunedin into disrepute. In addition, you must acknowledge the origin (Tourism Dunedin or DCC) and author (as specified in the metadata) of the Image in any use of that Image.
You will defend and indemnify Tourism Dunedin and DCC against all costs, expenses and damages incurred in connection with any claim against Tourism Dunedin or DCC arising out of or related to: (a) a breach by you of these
Conditions of Use; (b) the use of the Images either alone or in combination with any other material; or (c) any claim by a= third party related to the use of the Images either alone or in combination with any other material.
The Images are provided to you on an "as is" basis. Tourism Dunedin and DCC do not give any warranty or other assurance as to the accuracy, completeness or fitness for any particular purpose of the Images appearing in the online image library. To the fullest extent permitted by law, Tourism Dunedin and DCC disclaims all responsibility for any damages or losses (including, without limitation, financial loss, damages or loss of business, loss of profits or savings, direct and indirect or consequential damages or losses) arising in contract, tort (including, negligence) or otherwise from the use of, or inability to use the Images or from any action or decision taken as a result of using the Images. If Tourism Dunedin or DCC becomes liable to you for any form of loss or damage, Tourism Dunedinʼs and DCCʼs liability to you arising out of all claims for loss or damage under these Conditions of Use will not exceed in aggregate an amount equal to the purchase price actually paid for the Images.
If, for any reason whatsoever and at its sole discretion, Tourism Dunedin and DCC wishes to terminate this licence, it may do so immediately by giving written notice to you. On receipt of this notice, you must, as directed by Tourism Dunedin and DCC, return all copies of the Images or destroy all copies of the Images that are in your possession. You must also provide a written undertaking that no further copies of the Images are or will be used or retained by you for any reason.
Tourism Dunedin is the trading name for the Tourism Dunedin Trust Inc. The name and logo of the Tourism Dunedin Trust Inc are registered trade marks. You are not permitted to use or reproduce or allow anyone to use or reproduce these trade marks for any reason without Tourism Dunedinʼs express written consent. These Conditions of Use will be governed and interpreted in accordance with the laws of New Zealand
